Class Actions
In 2001, We expanded into the Complex area of Business and Employment Class Actions. Our Office has successfully certified several Employee Classes, representing anywhere from 250 to 180,000 Employees in their claims. We have also resolved several Class Action lawsuits, representing both Defending Corporations, and Employees alike.
Below you will find information about the status of several of our Pending Class Actions, as well as links to information about the cases. Fuller, Hackler vs. Kelly Services
This case has been certified for approx. 2,500 Kelly Home Care caregivers, and 180,000 Kelly Services employees. In March 2009, the Superior Court decertified the Class Action, and Plaintiff’s Appealed the Ruling. On May 17, 2010, the Court of Appeal overturned the Superior Court Decertification Ruling, and Upheld the Plaintiff’s Certified Class Action Claims. The Action is scheduled to be remitted to the Superior Court in July, 2010, and Plaintiffs hope to schedule a Trial date as soon as possible.
Huey vs Dana's Housekeeping
On August 10, 2009, the Court granted final approval of the Class Action Settlement, and authorized disbursal of the settlement funds. Settlement Checks are scheduled to be mailed to class members on approximately October 20, 2009. However, Defendant Dana’s Housekeeping failed to comply with the court order, and failed to provide the settlement payments to the plaintiff and members of the class. Plaintiff has filed a Motion with the court to enforce the Settlement and obtain a Judgment against the Defendants. Claims Period has Ended, and we are no longer accepting Claim forms.
